Update on this case, this is awful when did the victim become the villain!!!

The pornography case involving one Anthony Michael Dobson, a Norwegian national with his co-accused, Mustapha Drammeh, continued on Wednesday 17th September 2008 at the Brikama Magistrates’ Court with the testimony of a 15-year old girl (name withheld) who is said to be a victim this pornographic infamy.

This is not proper conduct in court!!! If I am reading this right (and I see no other interpretation) the LAWYER FOR THE DEFENCE is allowed to make unsubstantiated, uneducated and downright ridiculous assertions about the young girl and the JUDGE does not throw this fool out of court?

I was enraged when I read this ...

“I am also putting it to you that your facial presentation does not seem to be a virgin.”

What sane person would ever offer such a statement in a court of law as evidence as to whether this child was raped.Its absolutely appalling.

I bet Anthony Michael Dobson,Mustapha Drammeh and friends are getting sadistic pleasure listening to these ridiculous proceedings.

If he doesn't disappear before the end of proceedings, i'll be very surprised if he gets a custodial sentence.

What if the girl is lying? Is there any evidence for example, lab report that she has ANY sperm on her. Or she was volunteer and seduce the men later accused her for financial gain.

Maybe what was actually said during cross-examination was more like:-

"When asked if she was married, the young girl replied in the negative. Defence Counsel Touray then showed the young girl pictures and asked her whether she was the one in them. She replied in the positive. “Is it correct that you were laughing there,” he asked the young girl, who replied in the positive. “You will agree with me that from the facial appearance on the picture, you were happy,” the lawyer then told her. Touray is a well respected defence councel as a search on him shows. It looks like the reporting is letting down the system...

It sounds like a few people want that guilty verdict quite badly. I'd watch the film 12 Angry Men from 1957 for a view on that sort of thought.

Indeed what if wouldn't be the first rape case in which that has happened but does that excuse this Behaviour

What if she was wearing a short skirt, low cut top what if she had been in a bar ?
Does that make this a less of a crime there are many what ifs? But as we have no access to forensic or medical records we can assume there must be some evidence (the pictures are evidence to one of the charges) maybe further alone the case we may hear of my evidence.

Perhaps people just want fair counsel? The job of any advocate is of course to establish the true facts and indeed, the girl might be lying. But stating that a photograph of her smiling implies she's responsible for what happened to her is pretty sick.

What is the age of sexual consent in Gambia, btw? And how is the legal position where rape might have happened in addition to consensual sex? Admittedly that is hard to prove even with DNA. Anywhere in the world can be found old men who want to indulge their unchecked immoral urges with young girls (or even boys) and the children who provide for them but a charge can be upheld against the old pa if he has had sex with a minor, consent notwithstanding, if the law is in place.

This is the sort of stuff that might establish the facts of the matter, yes. Surely you wouldn't agree that somebody's subjective opinion of facial expressions is admissible?

The legal age of consent is sixteen years. Rape and assault are crimes under the law. The law does not differentiate between married and unmarried women in this regard. Any person who has sex with of a girl under the age of 16 is guilty of a felony (except in the case of marriage).

Formby thats exactly what I was thinking. How is that evidence

As im assuming its only men that posses this gift id love to the know the secret of telling someone's virginity status by facial expression.

I’ve no idea where the defence is heading and can only guess he is trying to downgrade the rape charge to consensual underage sex by showing her appearance at the time does not tally with her account of a violent rape. A photo taken at an incident is strong evidence no matter what it shows. I’ll await the outcome of the proceedings.

I just pointed out another article that shows another view of the same case but seemed to be written in a way that possibly reflected proceedings more accurately. Having read both articles I’ve now heard enough about the sordid incident and hope things run fairly in Court.

I have no interest in these types of crimes and consider him, as we call it in England, a ‘nonse’ which means he is guilty of a nonsense crime or a crime that makes no sense to normal people and usually involving children. The fact that she was very close to 16 is a small credit but still not enough.
If he was jailed in England or USA for this type of crime he would get what he was due from other inmates who all look down on this behaviour.

If he’s jailed in Gambia I’m sure the prisoners will welcome him to a place that if I can be excused the recent overuse of the term will bring a whole new meaning to the term ‘Slumming it’…
