Deputy PS Pleads Not Guilty To Charges

The deputy Permanent Secretary at the Department of Forestry and Environment, Mr. Modou O. Njie, who was reported to have been arrested since the 21 of February, has on Monday, appeared before Magistrate Kumba Sillah Camara of the Bundung Magistrate Court to begin his legal battle on two separate charges.
Mr. M.O Njie is charged for publication of false news contrary to section 181A of the Criminal Code Cap 10 Vol III laws of The Gambia 1990, as amended by the criminal code amendment act No18 of 2004 and No 3 of 2005.
The particulars of offence stated that Modou O. Njie on the 19th day of February at paparazzi bar in the Senegambia area, Kombo North, Western Region of The Gambia has recklessly or having no reason to believe that it is true informed Musa. K. Musa that Amadou Samba is not the true owner of the Daily Observer, thereby committed an offence. The second count is impersonating public officers contrary to section 93B of the Criminal Code Cap 10 Vol III laws of The Gambia. The particulars of offence states that Modou Njie on diverse dates between January and February at paparazzi bar in the Senegamgia area of Kombo North, Western Region in the republic of The Gambia has falsely represented himself to the officers of paparazzi bar to be a person employed by the state house of the republic of The Gambia for the purpose of receiving preferential treatment thereby committing an offence.
When the particulars of offence were read out to the court, he pleads not guilty to both charges. The prosecutor ASP Bojang appealed to the court for adjournment so as to enable them to be better prepared for the case.
The defense Lawyer, Lamin Camara, appealed to the court to grant his client bail since he has been detained for two weeks and he has relatives and friends who are ready and willing to meet the conditions imposed by the court.
The court granted Mr. M.O Njie a bail bond of D100, 000 ( One hundred thousand dalasi) with one Gambian surety who must swear an affidavit of means with an identity card and furnish the court with a reachable contact. The case is adjourned to the 18 March 2008.
