26 PURPORTED SEX WORKERS PLEAD GUILTY

Twenty six purported sex workers pleaded guilty when they were arraigned before Magistrate Richards of Bundung Magistrates Court on Monday 11th December 2006 on a charge of rogues and vagabonds. The sex workers who numbered about 31 were arrested after police raids within the Kanifing Municipality. The arrested sex workers were charged with being rogues and vagabonds contrary to section 167 (b) Criminal Code Cap 10 Volume III laws of the Gambia. Most of the sex workers pleaded guilty to the charge that was preferred against them, but five of them pleaded not guilty. They are to be tried separately.
Delivering his judgement for the 26, Moses Richards of the Bundung Magistrates court ruled that prostitution is not a crime, but the act of soliciting customers for prostitution is a criminal act, which is punishable by law. He warned that if any one of them wants to practice the trade let that person stay in her house for men to find her there. They must desist from this evil practice of soliciting customers, he posited. Magistrate Richards added that the evil practices might lead to the upsurge of sexually transmissible infections in the society, he cautioned them to be careful of their own health.

The Magistrate vowed that he would send all of them to prison in order to send clear signal to others and to deter them from committing similar offences. At this juncture, Lawyer Lamin Jobarteh intervened and pleaded on their (sex workers’) behalf in spite of the fact that he was not holding brief for any of them. Your worship, some of them are nursing mothers and if they are taken to prison, who will take care of their children for them? He asked. Lawyer Jobarteh maintained that he did not condone their act, but for humanitarian reasons, they deserved leniency from the court.
Magistrate Richards then ruled that he is ordering the 26 women to keep the peace and be good role models by desisting from the practice. He said he would let them go, but if they are arraigned before him within the next 12 mouths for committing a crime, they would be automatically sent to prison for six mouths for the present offence, and then tried for the fresh crime. He therefore ordered the police to take all their photographs and thumb prints for identification purposes. The prosecutor was 1748 Mballow of the Bundung Police Station

MAGISTRATE RICHARDS VOWS TO PUNISH

Magistrate Moses Richards has asked the police to probe into the operational legality of Bakadaji, Class One and City Pub Bar with immediate effect. Magistrate Richards made this statement when the police prosecutor 1748 Mballow informed him (Richards) that the police received a tip off that these bars and restaurants were being used as an avenue for sex trade.
Magistrate Richards told the police to investigate the operational licences and other legal documents obtained by the Managers of the above named bars and brothels. He ordered the police to summon any of them for prosecution if they are found to be operating with inappropriate documents. He said such managers would be charge for keeping brothels contrary to section 138 of the Criminal Code.
Magistrate Richards further urged the police to continue hunting prostitutes in bars and brothels around Fajara, Tallinding, Manjai kunda and the Tourism Development Areca (TDA) in order to root out this evil practice, which is inimical to our society’s moral valves. ‘Bring their proprietors too, I will try than accordingly’, he ordered.

Can you be more explicit. These people are part of our society. They grew up in homes and in a society. Those homes, societies and systems failed them to be where they are today. Forcing them are arresting them like this and paraded before every one only drives them underground.

Providing training skills and employment opportunities, sex education and how it relates to AIDS should be a better approach. It must take these people desperation to become what they make a living out of. Every one needs to be loved and they are part of our society which we cannot deny.

Such arests have only increased AIDS transmissions and many workers in this area will tell you this. They become invisible to be given the medical advice they need inorder not to infect many others.

Unfortunately the market must be there for their service to wanrrant such a large arrest. By simple arthmetic, each lady arrested must have atleast 10 to 15 clients which means there are more men out there than the women arrested who are equally culpable.

have every reason to jump in to some one house.
and this people didnt grow up in the societ as where
they are today Neither have they educated them this way.
We Gambians have growing almost in thesame house so there a little
diference among us but the changes comes only later.
so are you saying they parents /relatives know what they are doing?
if the systems makes one broke the rule you most be then a foolish!

If men didnt use prostitutes then there would be no trade!
If it is open then it can be regulated and people can get health checks.

Remember these women are someones daughter. We might not think their chosen path is a good one, but they are still human and still deserve respect.

Kondorong, you are absolutely right.

If they want to make a example, they should make it of their clients too; and of course of the pimps. As long as only the women are accused and clients can feel safe, nothing will change.

In addition to it, Gambia's reputation as a tourist destination is in danger. If the country really wants to attract a better clientele than Thailand or the Philippines, the officials must take action.

If that quotation is generally true, then some africans would not risk their lives on the boats to the Canary Island and end up being deported. What europe is saying is that even though doors in your country are closed, ours are not open either. That these boys must be prepared to lock themselves in the dark dungeons of africa.

Mbay, verstehst Du nicht? Kein Mensch hier will Prostitution!! Aber gleiches Recht soll für alle gelten - also auch für die sogenannten Kunden. Willst du nur die Frauen beschuldigen und diese widerlichen Kerle in Schutz nehmen?

Its always the blame game. Its always the case that Gambians dont do this or that. We need to wake up and realise that we as Gambians are capable of doing wrong.

In any case they must have Gambian clients atleast. It cant be foreigners only.

I dont understand German, and using it and not translating is an indication that you feel right and would not give in. However looking at the word used ("euch") it sounds like the english equivalent of "out".

These people are not going anywhere and they will stare in our faces becasue some are Gambians and becasue there are Gambian clients. It cant be all foreigner club.

Like the wollofs say: NULA UDEH GISSEH, NONU LA LAYE OWALEH. These people live in homes that belong to Gambians. Atleast some people must be culpable.

Kondorong, 'euch' means 'you', accusative plural of du = you. Mbay said: 'Away with you!', and I don't know if he meant us or the (allegedly foreign) prostitutes.

I don't know about Gambia, but in Europe many prostitutes are drug addicts. They need a lot of money for drugs every day, that's why they take to prostitution. Of course these women live with the highest risk of HIV infection; they are a public danger. But though they know the risk men are stupid and irresponsible enough to have sex with these girls. There are things about men I will never understand. But this of course is also a blame game.

weg mit Euch = out with you. So Kondorong, there was 'out' in the sentence, but that is the translation of the word 'weg'. 'Euch' means you, plural.

Didn't we have this discussion about prostitution before very recently? I remember Santanfara telling us that for some of these women we sadly had to conclude that their menfolk let them down.

Sorry, Anna, 'out' means 'raus'. This is a trifle, but maybe of some importance here. I don't know if Mbay meant 'Raus mit Euch', but he seems to believe that people who have to do with prostitution are all foreigners. Mbay: 'Ausländer raus' - is his really what you think????
