Ahhhhhhhh so the RED words are what caused the NIA to get involved,as you can deduce from the complainants words show :"I quarreled with an Indian man and the Indian insulted the president after which I did not report the matter to any place,"

Action taken for racial verbal abuse.....errrrrrrr NO.

Now that the story has emerged I detect a little backpeddling by the D.O. to try to reinforce that the charges were brought because an Indian had spoken his mind not about Gambians, but about the president,this case has opened an arguement that has escalated from a small utterance from an angry man,and more importantly in the way that the NIA chose to proceed,into something that may well have repucussions of future trade links with India and the Gambia,Tractors for KMC and Baja 3 wheelers etc.The indian community is very close knit and are often excellent in business.

It has been realised that people whom out of the hospitality of the citizens of this country, are earning their living here, are abusing that hospitality. The recent charging of an Indian for uttering racist remarks against Gambians is an example of what we are talking about. Since the case is presently in court, we would allow the law to decide. But we want to remind those who thought our publication of that story tantamounts to maligning the Indian community resident in The Gambia and the Indian nation at large to be conscious of the fact that we were only doing our job as responsible journalists to inform people about events in the society.

Hospitality is all about opening up to others and accommodating them; that is why The Gambia is called the Smiling Coast of Africa. However, this spirit of hospitality must not be taken for granted by others to the point of assaulting our dignity, sovereignty and respect, and dishonouring the Office of our President. Those who are in the country simple because of our capability to promote unity in diversity must therefore conduct themselves accordingly and not otherwise.

One thing is certain, The Gambia has gone beyond the days of unforgivable and terrible slavery inflicted on our ancestors, when innocent and decent people were deliberately captured and subjected to all forms of inhumane treatment in the name of slavery, hence they were deprived of their dignity, respect and love. The country is now quite different in many ways, especially in terms of human development through provision of quality and affordable education to all citizens regardless of social status and backgrounds. Such enlightened minds are ready to defend and uphold the sovereignty and territorial integrity of the country at all times whenever the need arises and also prepared to battle challenges facing the country's development objectives in this 21st Century.

We therefore hope that the culture of tolerance, civility and forbearance would continue to guide the actions of all those who in one-way or the other making a living in this country. These virtues would help secure personal fulfillment for all and sundry by putting to rest all vices that have the potential to obstruct the normal order of society. Let us therefore uphold them and respect each other's integrity.

TRYING TO SPLIT THE KEY WORDS TO UNDERSTAND WHAT THEY IMPLY

LAZY = TO A FOREIGNER THEY ARE BECAUSE GAMBIANS ENJOY APRC TRANSFORMING IT TO ONE OF PATRONAGE & FUNFARE; AS EVERY MONTH THERE ARE CARNIVALS, SLAUGHTERING OF BULLS, DISHING OUT MONEY & MERRY MAKING AROUND THE COUNTRY PATRONISING JAMMEH WHILST POVERTY INCREASES (i.e. people are hungry and price of commodities rising)

BLACK MONKEYS = A GENERIC OFFENSIVE RACIST TERM USED BY RACIST

STUPID PRESIDENT = SAME MENTALITY WITH OTHERS WHO SEE HIM THAT WAY OR WORST THAN THAT

LEAVING TRIAL AT KANGAROO COURTS

Kobo, far too deep, the man was angry because a worker failed to turn up for work,he lost his reasoning and just exploded,he didn't think about the implication of his words on the listener,or anyone else who may have overheard,(part of their job )nothing more than that.

Toubab. Its not as simple as that? Sensitive comments were made and may be insults to OUR NATIONAL PRIDE The prejudice comments also depends on individual judgement and different circumstances to tolerate them

Better transfer it to the high Court then,its a win for the,defence get what they want,its a win for the magistrates, he dosn't want to be in the limelight for this blown up out of all proportion case,that has GIANT political undercurrents with the involvement of the NIA and MAYBE witnesses who are unreliable,no report of their testimony that I can find !

"Mballow pointed out that the issue of calling back three witnesses in the case is unjust, adding that the prosecution has closed its’ case and the case cannot be opened again. “It can only be done if the case in question is being transferred to another jurisdiction,” he said. He added that the accused was not even denied any right of bail. At that juncture, Magistrate Tabally adjourned the case to February 22nd, 2011for ruling and continuation."

QUOTES EXTRACTED FROM DAILY OBSERVER TO UNDERSTAND NATURE OF TRIAL;

1. "The particulars of offence stated that on 29 January 2011 along the Sayer Jobe Avenue, while in such a public place, the accuse used abusive words at one Isatou Singhateh [saying] that all Gambians are lazy black monkeys which irritated the accused in a manner likely to cause a breach of peace. The accused denied the allegation. "

2. "He then applied under Section 123 of the Criminal Procedure Code that the accused is a lay person and does not understand the procedure and proceedings as far as criminal matters are concerned. “I believe that the accused did not cross-examine the witnesses,” he stated."

3. "Counsel Batichally further stated that the case is a criminal matter and that the accused is at stake and nothing should be taken for granted, “I urged the court to give the accused opportunity to cross-examine the witness,” he said. The police prosecutor, Inspector Mballow recalled that at the last adjourned date the accused requested 10 days and was given 14 days to secure a legal luminary of his choice. “14 days is enough for the accused to brief the counsel and counsel should come to the court and go through the file. It is quite unreasonable,” he argued."

"Wednesday, June 01, 2011

One Mahesh D Bhojwani, an Indian businessman residing in the country, was yesterday convicted and sentenced by acting Principal Magistrate Sherrif B Tabally of the Kanifing Magistrates Court after being found guilty of prohibition of conduct conducive to the breach of peace contrary to Section 9 of the Public Order Act.

According to the particulars of offence, on 29th January 2011, along Sayerr Jobe Avenue in Serrekunda, Kanifing Municipality, while in a public place, Mahesh D Bhojwani used abusive words on one Isatou Singhateh, saying that, ‘Gambians are lazy black monkeys’, a manner likely to cause a breach of peace.

The accused person pleaded not guilty to the charge. The prosecution had called three witnesses who testified in the case, while the accused also opened his defence and gave evidence.

The prosecution was able to prove their case beyond all reasonable doubt. The presiding magistrate then convicted and sentenced the accused to pay a fine of D1,000 in default to serve three months imprisonment.
