Big problem can anyone be certain that there will be no breach of the peace if some form of bail is granted ?
Bearing in mind the implication of the established culture over many generations possibly hundreds of years.

QUESTION OF THE DAY
The high court will be on vacation until October after the end of this month. A Foroyaa reporter went to the high court in Basse to find out when the case of Koina 24 will resume but no registrar was found. Meanwhile time is moving. If the case is not heard up till the end of July, it follows that the accused may not have their case heard until October. Justice must be seen to be done by ensuring that no accused person is denied bail and forced to stay in detention for over a month only to stay longer because of the vacation of the judges. We hope the authorities will act.

What file is this the police refer to as their problem? Is it in fact the official Court record of proceedings when the accused first and subsequently appeared at Court ?
OR is it the POLICE file that has been lost, mislaid, destroyed, cannot be found, never existed ?
Bet NO OFFICIAL response will be published as a "Clarification "

Muhamadou Krubally has been discharged on his incitement to violence charge by Magistrate Omar Jabang of the Basse Magistrates Court.
This caste scuffle happened on the 23rd May 2019 in Koina, URR.
The accused person, Krubally is a member of the slave caste and resides in Koina in the Upper River Region (URR). He was remanded at the Janjangbureh Prisons for 15 days before he was granted bail.
Since the charge to the commencement of the case, the police have failed to regularize their case and for the trial proper to commence. They have always sought for adjournment to enable them acquire the file about the case until yesterday when they decided to withdraw the charge on Mr. Krubally.
When the case was called before Magistrate Omar Jabang on Monday 22nd July 2019, Inspector Sanyang who appeared for the Inspector General of Police, made an application to the Court relying on section 68(1) of Criminal Procedure Code for the withdrawal of the charge. The police prosecutor put forward that the prosecution has not yet got the file about the case. The trial Magistrate granted the application and discharged Mr. Krubally of the charge.
The caste system over the previous months has brought conflicts among people of the Gambia particularly the URR where many were left wounded while others face prosecution. |

The Standard newspaper has really got its act together publishing reports of Court Hearings in URR on the day they were made,Good JOB !!

The Janjangbureh high court yesterday discharged five of the people charged in the wake of the caste dispute that rocked Koina and some parts of the URR.
Those set free are Muhammed Sanneh, Jariga Camara, Bangally Kanuteh, Ebrima Gumaneh and Musa Kanuteh .
The court also granted bail to the following 17 persons: Hajjie Jabbi, Ousman Gumaneh, Musa Kumba Leman Kanuteh, Essa Gumbally, Bangally Gumaneh, Essa Jarra, Dawda Gumbally, Bangally Jawara, Bahoreh Gumaneh, Banta Gumaneh, Abdou Gumaneh, Momodou Lamin Gumaneh, Saikou Leman Gumaneh, Dawda Touray, Karaba Sissokho and Bakary Juwara.
Each was granted bail in the sum of fifty-thousand dalasi (D50,000) with one Gambian surety.
The accused persons were also ordered to deposit their ID Cards with the Registrar of the Court and warned not to leave the country pending the determination of the case.
They were further bound to keep the peace and to report to Basse Police Station every Monday.
Addressing the court, Justice Ebrima Jaiteh said the fundamental hallmark of the criminal justice system is that an accused person is presumed innocent until proven guilty.
He indicated that the prosecution did not provide enough evidence that the accused persons would jump bail, adding that the nature of the charge must be considered.
Justice Jaiteh further said that the accused persons are charged with arson which is punishable by life imprisonment whilst citing defence counsel L. S. Camara’s submission which drew the court’s attention to section 29 of the Criminal Code which stipulates that the court can sentence a convict to a lesser sentence.
The matter is adjourned to 28th October, 2019 at the Basse High Court.
The accused persons are standing trial on four counts of conspiracy, willful and unlawful damage of property, arson and assault causing actual bodily harm.
