I saw the coup play itself out on that Friday and saw the transition play out. I am not just sure if the Gambian people extended granting immunity to the coup plotters. Were our hands twisted to give that which we never had is a matter still to be debated. I also rememberd seeing a draft constitution that said two term limits but the final copy for some reason was not.
At some point, even the supreme court could not agree on the final copy of the constitution. The Clerk of the House who should have the true copy came up with a copy which was thrown out by the court. I believe Antouman gaye was attorney for a defendant.
So if the House is not sure, i am not sure if either of us is competent to to say that "...the Gambia people ultimately and overwhelming adopted, we enshrined the legality of the coup of 1994 because in essence we accepted everything in it (including the immunity for coup plotters) and rejected the 1970 constitution" if i may borrow your own words.
Certainly evey Gambian is affected by the coup either directly or indiretly, positively or negatively unless you are not a gambian. Personally i believe we needed a change of politics in the Gambia but i was in the minority to change the votes.
So be rest assured, that the coup found me in the opposition hoping for a change that never was.
But the topic is about legality which we should debate on matters of principle rather than sentiment.
I think the issues you and karamba have raised are genuine intellectual discourses that should be talked about to the benefit of all. Nothing political please.
We should be able to debate freely and convince each other. Thats what democracy is all about. After all neither of you can change what has happened but to discuss it, helps us build our country better. To move forward, we must learn the past. The present is almost non existent.
May be the two of you should consider teaching at the University because i am impressed with your levels of intellect and reasoning.

Hard to count a single person on this forum not bold enough to take up issues where they belong. There is no personal sentiment when it comes to collective stake. It is a country named Gambia that has been WRONGED and not simply isolated cases of individuals. The illegal move to rob that seat of political power has never been DECENTLY DEBATED by Gambians. Yes, there was a referandum that followed the coup. That was all done to catch in the big net those who would later stand before the whole of mankind to claim there being due process of law where it never was.
Since then lot of water has gone under the bridge. Better parts of the constitution have been amended to suit the criminal agenda.
In short, the referendum in question came about because LAW was broken in the first instance. To avoid being tried, the logical thing for our coup makers was to change the the very legal instrument that was to confirm them guilty of an offence severe as that.
Later on came the Indemnity Clause. The idea being to provide a protective safe net so that starting from the coup, all other crimes including the countless killings and several economic crimes become indemnified. Such are the issues open for genuine debate by all sincere persons, particularly caring Gambians. It is such issues needing attention and not the least about those who raise the issues. Crime and criminality in Gambia since remain normal because the regime in power came through the criminal route. Say no to that and let Gambians have their say too.

| The legality or illegality of any act most be based on the existing laws of the land. At the time of the coup by the AFPRC it was an illegal act by virtue of the laws of the Gambia. When the AFPRC took over they committed an offense or offenses which, had they failed to succeed in executing their illegal act/s, could have landed them in court for treason and associated offenses. As it turned out they succeeded and escaped the legal web so to speak. To legalize themselves they brought in a constitution and other decrees to further escape from legal entanglement. The PPP on the other hand were elected to office and if they committed any offense those were not, I submit on any legal statute up till the time of the coup. Surely Mansasulu in his opinion holds them liable for crimes which are in his own statute books and condemns them without any trial and found them guilty as charged too. That is alright for him but not for me because if you tell me that I am being tried for an act or omission you most tell me under which law you are trying me because it is that law or statute which determines the offense and the attendant punishment in the event i am found guilty. Can Mansasulu enlighten me as what offense the PPP committed and which particular section of the Laws of the Gambia he relied upon to indict them. An opinion is one thing but a statement of fact is quite another so please tell me where you got the offense/s from.Failure to live up to expectations and staying in power for too long cannot be offenses according to the laws of the Gambia, if they were please tell me which particular act of parliament passed the law, what it actually said , and do not forget to tell me the section,subsections and the date it was passed by our parliament into law. |

When deposed President Jawara was given occasion to address the coup makers while sailing away to Senegal, he made few remarks. One of it was a warning to the coupists about THE STRUCTURES. "I warn the coup leaders not to tamper with the structures."
Better understood, this message was meant to TAMPER (restrain)the coupists not to TAMPER (interfere)with superstructure of the government machinery. Perhaps the message was not understood. It could be that the coup leader picked that message to mean physical structures as in buildings, roads, and our famous airport.
Indeed, the structures have been TAMPERED to the farthest extent. Whatever that brings for Gambians, only those who feel it know it. |

Many thanks for authenticating. In a way the message fell on deaf ears. The coupists could not imagine change of seat from being authorised to becoming supreme authority. No doubt the entire system and structures continue being TAMPERED. |

In 1981 the first thing Sir Dawda said about Kukoi was " Aborrta" well this is 2008 and after 14 years Jammeh is still ruling. He aint gonna "borrta" and chances are will not be prosecuted for anything or any crime ,since none of it can be substanciated.
