The NAA must definitely have been so slippery at this time of the year. Anyway more seriously, I think Magistrate Jammeh was just trying to remind the lad that (APRC party) which he was part of did not like such. In the future Magistrate Jammeh such avoid such statements which is almost vague. He should used the Laws of Gambia as his main reference, which is for everybody irrespective of whose cow is gored.

Your observation on side of the Learned Magistrate is sharp and quite relevant. It provides material evidence that the laws and entire state machinery rest in the manipulating hands of Jammeh and his tool heads. One of them have earlier advanced the view that Jammeh is ABOVE laws of Gambia !!!

Reading law texts to pass assignments is one bit. Cultivating a balanced sense of JUDGEMENT (process of assessing a situation) for fair JUDGMENT (making a legal determination) are different things. In Gambia, Jammeh dominates the JUDGES, and their JUDGMENT. What more do we expect?

Its like what the mandinka say: NGANIYO BUKA NUKUNG (You cant suppress one's wishes. Sooner or later they become known.) This is what George Bush means when he said Judges must not legislate from the Bench.

For the Magistrate to say the the APRC Party does not like impersonation is too far. For him to say its illegal to impersonate is well within his legal realms and ofcourse within the realms of any descent individual to say that. Both statements are different.

Besides, the Permanent Secretary being impersonated is not an APRC Party Official, but a Civil Servant. What has that to do with APRC. If the accused had impersonated the Party to make money then it might be "safe" for him to say as reported, but even in such instances, he should not go as far as to speak for them as to what they want or do not like. The party, through its spokesperson, is better suited to do their own public relations portfolio. I am not sure if the Magistrate knows the difference between a Government and a State. They are very different.

Well.. then again, this is the Republic of GAMBA.(wollof word not to be mistaken for Gambia).

At end of this Jammeh nightmare, lot more people deserve re-schooling or de-schooling as preferred by Ivan Illich. In his book "Deschooling Society", Ivan Illich argued that formal education imparts certain modes of thinking and behaviours that conditions the "schooled" person in determined patterns of associating life. To Illich, that whole thinking process needs rectifying. In the case of Jammeh's Gambia, we have to start the process even while he is still there so that before the show is over, we end up with a correct and sane set of people. For those who like to explore into the thought patterns of Ivan Illich, a little search will help. Written in the 70s or 80, a 2000 reprint is also available. It is almost pocket size and handy to read on journeys.

This is indeed a proof of judicial competency.However the comments made by my learned friend Magistrate Jammeh( 'Magistrate Jammeh, then said that the accused person cannot be free because the APRC party condemns such evil deeds. He therefore sentenced Mr Cham to one month in jail, on Count One and 2 months in jail on Count Two'.)were unfortunate as political statements shouldn't be any basis for sentencing.
A crime has been commited and the culprit should face the true due process of the law regardless of any politicasl affiliation.It is imaterial whether the APRC party condems it or not once it is an illigal act,it should be prosecuted and convicted.
