THE NATIONAL ASSEMBLY SHOLD TAKE NOTE
It is very common for laws to be passed with penalties put in the millions. The recent law on dealing with false information online puts the penalty at 15 years imprisonment or a fine of 5 million dalasis or both. The earnings of people in The Gambia is on average less than 200 dollars a month. If penalties are more than the earnings of the average person for a life time whoever is found guilty is likely to serve a jail sentence for inability to pay fines. Custodial sentence is meant to put people behind bars who may be a threat to society or punish those who are unrepentant in committing crime. The law makers should therefore go back to the drawing board to look at the fines being enacted and review their impact on the criminal justice system of the country. Excessive fines may defeat the course of justice.
