Principal Magistrate Sherriff Tabally of the Kanifing Magistrates’ Court on Thursday adjourned the criminal trial involving the state against ex-magistrate Ma Nyima Bojang for ruling on no-case-submission. When the matter was mentioned in court, both the state counsel Simoen Ateh Abi and defence Lawyer Neneh Cham filed in their written submissions on no-case-to-answer, which were both adopted. It could be recalled that the accused is charged with accessory after the fact to felony, contrary to Section 26(3) of the Criminal Code Cap 10: 01, Volume 3, Laws of The Gambia 2009. According to the particulars of the offence, the accused person between the months of April and May 2013 at Sukuta and diverse places within the jurisdiction of the court received and assisted Benedict Jammeh, who to her knowledge was guilty of having committed a felony, in order to enable the said Benedict Jammeh to escape punishment, thereby committed an offence. She denied the charge. The state prosecution in proving their case called two witnesses while the defence chose to make no-case-to-answer submission. The case continues on October 23rd, 2013.
