"MANSA BENGO IN A NON MANSA ERA
The comments of the president on the powers of chiefs during the Conference of Chiefs known as Mansa Bengo, literally translated as the conference of Kings needs to be digested by the chiefs and put in their right context. When the British crown experimented with indirect rule through the protectorate system in 1894 the era of sovereign kings came to an end and the era of subjugated chiefs came to fruition shortly afterwards in 1902.
The Chiefs were put under Commissioners and the district tribunals they presided over to deliver what was regarded as native justice were subjected to the dictates of the Commissioners. The Commissioners were also placed under the dictate of the Governor and the governors were under the sovereign authority of the monarch.
The Gambia became a sovereign Republic in 1970. The Constitution of the second Republic states very clearly that: “The sovereignty of the Gambia resides in the people of The Gambia from whom all organs of government shall derive their authority and in whose name and for whose welfare and prosperity the powers of Government are to be exercised in accordance with this constitution.”
The Chiefs should bear in mind that before the amendment of the 1997 Constitution to move backwards from Republican values, section 58 called for the direct elections of chiefs by the people.
In 2001 this democratic provision was amended and section 58 (1) now reads:
“(1)The President shall appoint a District Seyfo in consultation with the Secretary of State responsible for Local Government. “ (2) The Secretary of State responsible for Local Government may, in consultation with the Divisional Commissioners, make recommendations to the National assembly for the creation of new Seyfo Districts.”
The amendments to the Local Government Act proceeded to introduce the position of paramount chief which was not in existence because of the absence of dynastic rule after the original kings and their dynasties were uprooted.
We wish to inform the Chiefs that they are functioning under a Republican constitution. They must know that governments come and go and systems could stay if they are democratic and people centred. The reason why you have the Boka Haram movement and all sorts of ethno-linguistic strife in Africa is because of the retention of archaic institutions that promote dictatorial and intolerant tendencies. Africa needs democratic institutions and a national culture that promote liberty, dignity and prosperity if we want to be examples in the world. Anything contrary to this would move us back into the stone age."
