5 NDEA officers arrested for ‘murder’

Five operatives of the National Drug Enforcement Agency (NDEA) have been arrested for allegedly causing the death of one Cherno Alieu Suwareh.

Ebou Lowe, Eku PL Grant, Abdoulie MK Jallow, Matarr Conteh and Modou C Jaw are currently in custody and helping the police in their investigations. Confirming this to our reporter Wednesday at the Police headquarters in Banjul, ASP Yerro Mballow, the Police public relations officer (PRO) said the incident happened on Friday 25th March 2011, when the accused persons raided Suwareh Kunda, a compound situated at Bakau Sanchaba. “During the raid, the NDEA officers arrested one Cherno Alieu Suwareh, commonly known as ‘Cher boy’ whose house was searched and some suspected quantity of Cannabis sativa was recovered,” he said.

According to the Police PRO, during the raid the late Suwareh had a confrontation with the officers as a result of which he was physically assaulted. He said the narcotics officers hit Suwareh’s head on the wall, which resulted to injuries on his forehead. “Eye witnesses also revealed that the narcotics officers used baton to beat the deceased. The deceased was then arrested and taken to Banjul NDEA charge office where he was detained,” ASP Mballow explained.

He further stated that on Monday the 4th April 2011 while Suwareh was under detention, he was reported sick and narcotics officers on duty rushed him to the Royal Victoria Teaching Hospital (RVTH) where he was admitted. “Eleven days later, that is on Thursday, 15 April 2011, Cherno Alieu Suwareh was pronounced dead,” the Police PRO added.

He said that the accused persons are charged with two counts, which according to him, are: Conspiracy to commit murder contrary to Section 204 of the Criminal Code Cap 10, 01; and murder, contrary to Section 187 of the Criminal Code, Volume 3 Laws of The Gambia.

Five NDEA officers indicted for alleged murder

The Banjul Magistrates’ Court yesterday transferred the alleged murder case involving five officers of the National Drug Enforcement Agency (NDEA) to the Special Criminal Court of the High Court in Banjul.

The trial magistrate further ordered the accused persons to be kept at the Mile 2 Central Prison pending their arraignment at the Special Criminal Court.

The suspects: Eku Grant, Ebou Lowe, Abdoulie E. Jallow, Mattar Sey Jawo and Alieu Conteh, all said to be NDEA officers, are alleged to have tortured one Cherno Alieu Suwareh, which led to his death.

When the case was called, the prosecuting officer, Sgt Manga, told the court that since the alleged offence is a capital offence, the prosecution was applying for the case to be transferred to the Special Criminal Court division at the High Court in Banjul.

He said the accused were charged with conspiracy to commit murder and murder.

Meanwhile, at a press briefing held yesterday at police headquarters in Banjul, the Police public relations officer ASP Yerro Mballow, said the incident happened on 25 March 2011 at Bakau Sanchaba, when a team of NDEA officers went to the house of the deceased, where a search was conducted and some suspected cannabis found.

He said in the course of arresting the late Cherno Alieu Suwareh alias “che” there was a push and pull between the deceased and the officers, who beat him up and as a result the deceased sustained serious injuries on his head.

“Suwareh was subsequently arrested and taken to the NDEA main office for interrogation,” Police PRO Mballow told reporters.

“During the course of the investigation, there was an eyewitness who informed the police that before they whisked away the deceased to the NDEA main office in Banjul, he saw the officers seriously beating Suwareh with a baton, which also caused some injuries,” the police spokesperson continued.

After eleven days, Suwareh claimed that he was feeling sick, and was taken to the Royal Victoria Teaching Hospital (RVTH) in Banjul for treatment, where he was admitted for a few days before he died, according to ASP Mballow.

Three of five national anti-drug agents standing trial on the murder of Cherno Alieu Suwareh, a resident of Bakau have been acquitted and discharged on Monday.
Mr Suwareh, in his 20s, a drug suspect is said to have died as a result of severe torture unleashed on him by the five officers of National Drug Enforcement Agency, NDEA, who raided his house.
He died at Royal Victoria Teaching Hospital (RVTH), The Gambia’s main referral hospital in Banjul on April 15 - eleven days after his was hospitalised.
Such a tragic incident involving state security personnel was the second of its kind in three months; Dembo Sibi, 30, was also tortured to death in January by Police Intervention Unit (PIU) at Numuyel village in rural Upper River Region. Two were sentenced to death in May in connection to his murder.
In the drug officers’ murder trial, however, Justice Ikpala of the Special Criminal Court in Banjul said the state has no evidence to link Abdoulie MK. Jallow, Matarr Conteh and Modou C. Jaw to the crime even though no witness so far testified.
Ebou Lowe and Eku Grant, meanwhile have a case to answer, despite pleading not guilty.
The case resumes June 22, 2011.
