THE DRAFT CODE OF CONDUCT OF NADD MEMBER PARTIES

1ST FEBRUARY 2005
NADD/CODE OF CONDUCT

We, the Executive Members of NADD:

Bearing in mind Article 15 of the Memorandum of Understanding of NADD adopted on 17th January 2005, which calls on the Alliance to establish a Code of Conduct for member parties and supporters within one month of the coming into force of the agreement to ensure that slander, intimidation, inducement and appeal to ethnic, religious and other divisive sentiments shall be expunged from the platform of the Alliance;

Noting that adherence to laws that aim to put at bay tribal, religious, sectionalist and other secretarian extremism signify both political decency and maturity since then breach can be selectively sanctioned by agreement to inject a sense of despondency, hopelessness, demoralization and political apathy among the people;

Noting further that injecting political apathy on the side of the members, supporters and sympathizers of its opponents is the last instrument of survival of a discredited regime;

Conscious of the provisions in the Constitution, which prohibits the organization of a political party on ethnic, sectional, religious or regional basis or with the object to overthrow the constitution and subvert democratic ideals;

Being mindful of the provisions of the Public Order Act and the conditions attached to the use of loud speakers, which prohibits the use of threatening, abusive or insulting word or behaviour in any public place, at any public meetings or on the occasion of any public procession;

Recalling the provisions of the Elections Decree, which makes it mandatory for parties to adhere to a Code of Conduct prepared by the IEC, which prohibits insults, slander of candidates, abuse or improper use of government properties or facilities for political propaganda;

Being conscious of the laws prohibiting bribery, treating undue influence, personation and other corrupt electoral practices,

Firmly convinced that building pillars of integrity in words and actions shall strengthen the partnership among NADD member parties and between NADD and all civil society organisations and the international community and build public trust and confidence in its leadership,

Being further convinced that adherence to a democratic code of conduct would prepare NADD to pioneer the establishment of a government that would adhere to the principles of the rule of law, respect for human and peoples’ rights, the dispensation of independent, impartial and unfettered justice and prepare it to be a signatory to the

Memorandum of Understanding of the Africa Peer Review mechanism to make our country an example of best practices in democratic governance;

Hereby declare our unflinching support for and unwavering obedience to the following Code of Conduct:


HARMONIZATION AND COORDINATION OF PRINCIPLES, POLICIES AND ACTIVITIES AMONG MEMBER PARTIES

1. All Member Parties shall foster greater understanding of the provisions of the MOU, the Constitution and manifesto of NADD among their members as the three strategic instruments to rely on to act jointly and collectively to promote and achieve the strategic objectives of NADD.

2. During the lifespan of NADD each Member Party shall regulate its activities to promote the objective of NADD and shall, at all times subordinate all its policies, programmes and activities to that of NADD.

3. All Member Parties shall always be bound by the principle of good faith in their dealings with each other, draw attention to any infringement of the Code of Conduct during meetings of the Executive and other Committees and maintain strict confidentiality in discussing differences to ensure their amicable settlement by NADD’s own internal mechanism.

4. Members parties shall not hold rallies, sensitization campaigns, party fund raising activities and national congresses, provided that each party shall receive membership contributions and hold regular and extra-ordinary meetings of its organs as internal consultative mechanisms in order to make decisions to promote the objectives of NADD.


PILLARS OF INTEGRITY

1. No member party shall utilize information or resources acquired through its membership of NADD to promote its individual party interest or the selfish interest of any of its members;

2. No member party shall utilize NADD to defend its own individual partisan interest, programme and agenda;

3. In their participation in all NADD programmes, a member party and its members shall display honesty in all its dealings and shall avoid any word or practice that brings NADD and its member parties into disrepute.


PUBLIC TRUST AND CONFIDENCE

All member parties shall encourage their members to act in the interest of the public as a whole in the performance of all tasks for NADD and shall do so with objectivity and openness.

NADD AND THE MEDIA

1. All member parties shall always seek to give authentic, factual, objective and authoritative information, raise the standard or quality of political debate, concentrate less on trivial opinions and give more weight to substantive issues of public concern.

2. Only organs of NADD and their authorized spokespersons may issue statement to the media on its behalf.

3. Spokespersons of NADD shall convey views in the promotion of the Alliance or its defence in a respectful, couth and well-informed manner and that are fully substantiated. They shall address all issues in the media affecting the Alliance in a timely fashion; they shall not engage journalists in a confrontational manner or shy away from interviews to cover themselves up from media inquiries.

4. The freedom of expression of members of political parties shall not be hindered in the legitimate defence of their parties but such expression shall not result in misrepresentation of NADD; the trivialization or denigration of its existence and the erosion of its integrity
