As explained in the article in The Point:

" it’s not clear why the man entered the Kanifing Magistrates’ Court with a cutlass or the reason of him going armed in public. However, in Gambian law, it is prohibited to go armed in public."

The arrested man must appear in court swiftly ,to explain his actions.

Personnel of the Police Intervention Unit (PIU) that were deployed at the Kanifing Magistrates’ Court during the trial of Gambian rapper Killa Ace and 36 others on Tuesday arrested a man with a cutlass as he entered the court complex.

At the time of gathering this report, it’s not clear why the man entered the Kanifing Magistrates’ Court with a cutlass or the reason of him going armed in public. However, in Gambian law, it is prohibited to go armed in public.

The said cutlass was wrapped in a plastic bag. The accused was later handcuffed by the PIU officers and escorted to a waiting police van, which was stationed around the Kanifing Municipal Councils’ (KMC) main gate before taken to an unknown location. Blood was seen coming out of his mouth, but it was not clear to The Point the reason of the oozing. However, onlookers believed he was beaten by the PIU officers.

In a separate development but a related issue, our reporter has been reliably informed that seven suspects who were part of the 37 accused persons, but escaped during the first court appearance, were later rearrested by security personnel.
A source who spoke to our reporter on the condition of anonymity added that the seven accused persons have been charged with unlawfully escaping from custody and will be appearing before a court probably next week.

Activists and families members on Tuesday frowned at personnel of the Police Intervention Unit (PIU) for manhandling some accused persons as the case involving Killa Ace, and 36 others continued at Kanifing Magistrates’ Court.

The accused persons face eight counts including unlawful assembly, prohibition of conduct conducive to breaches of the peace, arson and rioters demolishing building.

Dozens of PIU officers were present at Tuesday’s court hearing at the Kanifing Magistrates’ Court, with some PIU officers spotted throwing some accused persons to a waiting police van within the court’s premises.

However, police say the accused resisted to board the waiting van.

Some angry youth were shouting and saying: “You guys should learn a lesson from the past regime. We are all seeing what’s currently going on at the TRRC. Before arresting people why not you tell us the people that killed Ousman Darboe,” they queried.

The late Ousman Darboe wife’s was also seen within the premises of the court.

Alieu Bah and some activists also took the main highway marching towards Banjul and demanding the unconditional release of all the 37 arrested youths.

“We will not allow anybody to take us to those days of Yahya Jammeh even if it means giving our lives,” Dabakh Malick, an activist said during an interview.

He said: “So many people have lost their lives and others went into exiles during the former regime and others lost their lives just to bring in Barrow’s government,” he added, saying that “if they think they are in power and that they have The ECOMIG and soldiers, we have our rights and we’re going to stand here in the Gambia and fight for those rights. Nobody is taking us back to the days of dictatorship.”

“I am not standing here to defend anybody who did arson, but even whereas the person is going through court process; even if he is guilty; he is a human being, he needs to be treated with utmost respect. However, you can’t be slapping and kicking people just because they’re inmates.”

According to him majority of the young people that were present on the ground were agitated because they don’t have jobs. “They’re agitated because they’re frustrated and they lost hopes in this country. Don’t allow the authority to use you and you are brutalising people.”

“Today in our presence, we saw you beating our own people. They’re accused persons and it’s wrong for you to beat them,” Kexx Sanneh said,

“We are ready to fight against dictatorship in the country and we’re not going to entertain it anymore. We are tired. We stood here when you people are supporting Yahya Jammeh and fought against dictatorship. In fact, most of you were enablers during the former regime.”

“We must all resist. Gambians youth must go out and take this country from our failed politicians,” Alieu Bah stated.

Magistrate Donn-Njie of the Kanifing Magistrates’ Court on 3 September, 2019, transferred the case involving Ali Cham alias Killa Ace and 36 other Serrekunda Market demonstrators to the High Court. They were charged on eight counts of conspiracy to commit a felony, unlawful assembly, prohibition of conduct conducive to breaches of the peace, arson, rioters demolishing building and rioters injuring machinery.

When the case was called, Superintendent Mballow told the court that he was representing the IGP while Lawyer Abdoulie Sissoho announced his representation for the 31st accused person and the others.

Superintendent Mballow informed the court that seven accused persons who escaped from lawful custody were rearrested and would be charged with escaping from lawful custody. He noted that one of the accused persons had reported to the court.

Magistrate Donn-Njie, in her ruling, told the court that the case was adjourned for Superintendent Mballow to reply on points of law. She further stated that it was not necessary to go ahead with the deliberation of the prosecution and the defence.

She held that counts 4,5,6 and 7 are capital offences and are not bailable. She further noted that the court does not have the jurisdiction to hear the counts, stating that both the prosecution and the defence agreed that they are capital offences and the court does not have the jurisdiction to hear such counts.

As a result, she disclosed, the Chief Justice has provided the establishment of the Special Criminal Division for capital offences. She declared that the court was recusing itself from the case. She ordered that the accused persons be remanded at Mile 2 Prison, pending the hearing of the case at the High Court.
