Famara Bojang, an alleged fraudster was recently arraigned before Magistrate Joof of the Kanifing Magistrates’ Court on a charge of obtaining money by false pretence.

To prove his case beyond reasonable doubt, Police prosecutor ASP Jallow earlier called his first witness, Samba Bah, to tell the court what he knew about the matter.

Continuing his testimony, the witness told the court that he called the accused on his phone and put it on loud speaker and gave the telephone to his friend to speak to the accused. He further noted that his friend told the accused that he, the accused, does not have a land.

Mr. Bah testified that the accused replied that it is true that he does not have a land. He said that he took the phone from his friend and told the accused that he gave him the impression that he has a land for sale and the accused told him that he was working on the papers. He said he paid him D350, 000. He added that after giving the money to the accused, he was not given the land neither was he issued with a transfer of ownership document.

He went on to say that he paid the money in installments, noting that the first payment was D200, 000 and the second payment was D150, 000. He confirmed that the accused issued him with receipts.

At this juncture, ASP Jallow showed him the receipts to go through them, which he did and told the court that he could identify the receipts by the letterhead which was ‘Vision Real Estate’ and the name of the person to whom the receipts were issued.

ASP Jallow then applied to tender the receipts. They were then shown to Lawyer Sillah who held brief for Lawyer Mene. She went through them and told the court that she was not objecting to the tendering of the receipts if they were going to be tendered for ID purposes. The prosecuting officer confirmed that he was tendering the receipts for ID purposes.

Mr. Bah further told the court that the accused pleaded with him to give him time to pay the money but he failed to do so. He adduced that the matter was reported to the Brusubi Police Station, and was later forwarded to the Serious Crime Unit. He stated that the accused has not given him a land neither has he paid him his money.

Under cross-examination, the defense counsel put it to him that he was not part of those who were transacting the land, and he replied that he was in the picture and paid money to the accused. He added that each time he paid money, he was issued with a receipt.

Prosecutors alleged that the accused, Famara Bojang, sometime in the month of January, 2018, at Bakoteh and diverse places within the Kanifing Municipality of the Republic of The Gambia, by false pretence and with intent to defraud, obtained the sum of D350, 000 from Samba Bah for the sale of two plots of lands measuring 20m X 25m each, situated at Salagi with the representation that both lands belong to him, which he knew to be false.
