I presume the 250 grams (not grains as reported) is for sale not personal use. In that case, the defendant may be facing a felony possession of a prohibited substance. This is not near in comparison to what "Jesus" was selling for the "Big man" , but in some jurisdictions it could fetch 10 year jail term. So the sentence itself may not be excessive, but I am not sure what the grounds of the appeal would be...

Quite so Kay, perhaps you misunderstood my question,all I was asking is the 5 years mandatory as at the lower court he was given 3 years by the magistrate ,was that technically incorrect? In my opinion both the fine and imprisonment sentence were excessive.
