UDP Rebuts DOSCIT

The question of whether the arrest and detention of Mr Nfamara Bojang, the UDP-sponsored candidate for Bakau constituency, were politically motivated or not is still a hot political potato. The Department of State for Communications, Information and Technology had earlier on eloquently advanced that Mr Nfamara Bojang was involved in an ongoing trial regarding the possession of falsified banknotes. However the United Democratic Party, in a press release has dismissed the claims, putting the DOSCIT on the firing line. The UDP press release accused the Department of State of deliberately suppressing relevant facts that could enable Gambians to arrive at a reasonable conclusion as to whether or not Mr Bojang’s arrest and detention were politically motivated. Below is the full text of UDP ‘s statement:

The Department of State for Communications, Information and Technology has caused to be published in both the print and electronic media the Government’s purported justification for the arrest and detention of Mr. Famara Bojang, the nominated UDP candidate for Bakau Constituency. The Department of State for Information has suppressed relevant facts that would have enabled Gambians in general and the electorates of Bakau in particular to arrive at a reasonable conclusion as to whether or not Mr. Bojang’s arrest and detention were politically motivated.

According to court records MR. BOJANG was in 2005, together with one ABDOULIE SOWA, arraigned before the Brikama Magistrates Court on two counts. The case file is numbered Criminal Case No. 18/05. The Charge Sheet is dated 8th February and it reads:

“IN THE BRIKAMA MAGISTRATES’ COURT CR. CASE NO. 18/05

INSPECTOR GENERAL OF POLICE

VS.

ABDOULIE SOWA AND NFAMARA BOJANG

Count 1: Conspiracy to commit a felony contrary to Section 368 CC

Abubacarr Sowa and Nfamara Bojang on or about the month of January 2005 at Busumbala you jointly conspired to commit a felony.

Count 2: Possession of forged notes contrary to Section 334 CC.

Abubacarr Sowa on 22nd January 2005 at Busumbala Village in Western Division, without lawful authority or excuse found in possession of D9800 forged D50 bank notes knowing the same to be false”

According to the records the presiding Magistrate Mr. Jawo first sat on the case on 10th February 2005. The prosecution did not call any witness until April 14, 2005 when a Corporal Saho of Yundum Police Station took the witness stand and testified. There were 18 sittings of the court between 10th February 2005 and 19th January 2006. On 19th January 2006 the Presiding Magistrate struck out the case and discharged Mr. Bojang because the prosecution could not present any witness to the court.

On Sunday 7th January 2007 barely 24 hours after his nomination Mr. Bojang was arrested by plain clothes officers and taken first to Bakau Police Station and finally to Wellingara after being briefly held at Yundum. On 10th January 2007 Mr Bojang was arraigned before the Brikama Magistrates Court.

The Charge Sheet which is dated 10th January 2007 reads as follows:-

“ IGP VS. N’famara Bojang

Count1: Conspiracy to commit a felony contrary to Section 368 CC.

N,famara Bojang on or about the month of January 2005 at Busumbala Village in Western Division conspired with Abubacarr Sowa to commit a felony.

Count 2: Possession of forged currency notes contrary to Section 334 Cc.

N’famara Bojang on or about 23rd January 2005 at Coastal Road in Western Division without lawful authority or excuse you were found in your possession D4550 forged Gambian notes knowing the same to be false”.

The records of the court show that the prosecution pressed for Mr. Bojang’s remand for a forth-night i.e. the entire campaign period for the reason that the police needed more time to carry out investigation.

Between 19th January 2006 and 4th January 2007- a lapse of one year less 13 days - the Police did not arrest Mr. Bojang. It did not occur to the Police and indeed the Government that is controlled by the APRC that Mr. Bojang needed to answer to criminal charges until he was NOMINATED to contest as the OPPOSITION U.D.P candidate in Bakau. Why wait that long? Why have the police not waited until January 26th or any date after January 25th? What is the underlying motive for Mr. Bojang’s arrest? Why is Abubacarr Sowa not charged this time? Why have the Police (Government) decided to charge Mr. Bojang with possession now and not in 2005? Is the criminal justice system being put into proper use?

Several other things transpired in Commissioner of Police Samba Kebbeh’s office in Yundum after the court admitted Mr Bojang to bail but as these are not recorded, it is not necessary to state them here.

The Department of State for Communication Information and Technology has deliberately suppressed the facts so as to create the impression that the action of the Police, which is contrary to Article 5 of the M.O.U, is not politically motivated.

Gambians and any person reading this re-joinder can now draw a rational conclusion from this and the statement issued by the Department of State for Communication Information as to whether or not Mr. Bojang’s arrest and detention were politically motivated.

APRC government and those appointed in posistions of trust are the most untrustworthy. What transpired in the case of Mr Famara Bojang is gross travesty of justice. It is a calculated move to reduce the prospects of Mr Bojang and to make him appear mean under the eyes of Bakau electorates and good thinking members of Gambian society. APRC in power means Gambians faced with the most indecent and malacious public officials. It is sad and shameful.

THAT reminds me . a lot the green boys were saying Baba jobe was the cause of all bad blood in Gambian politics yet he is behind bars for a while now but little has change. it was like during Jawara's time people were saying jawara is not a problem it is ministers. this is noncence. the man at the top most take blame for all bad action and the misrule. arresting some body so close to election only mean one thing ,to discredit him. yet the most acclaim mou is a just a white elephant. any actions the secratary of state,the police, army, nia and mad supportes are authorise by yaya. peroid. the guy is not as stupid as people thought him to be .all those secretary of state scretly swearing at him are the stupid ones. he deep him in dirt and discard them tainted. look at manlafi jarju his one time praise singer. where is sidat jobe ?
