I thought IEC was a Government institution funded by tax payers. How come they have private lawyer.
Oh i understand, now. The attorney generals chambers is the prosecuting office and cannot also be defense attorneys in the case. What is worth noting is that IEC's attorney i think is the wife of a one time APRC bigwig who has fallen out of favour with the government. Wow what a tangle of webs.
Truly, opposites attract. Physics is a funny subject. I could not understand this principle while in school.

Kons.,
That principle in physics is real, and i enjoyed it a lot-even going by nature. Unlike poles attract.females attracted to males, verse versa, unless they are "happy/gay".
I understand further you are making a point regarding the said lawyer, wife of a former associate. Tell us more please.
thanks

I beg your pardon I thought you said there was no room for challenging the results of the elections in Gambian law. Please , refer to my post under "what's the future of democracy in the gambia?". |

Does anyone know the outcome of the case? Was it thrown out really? I do think the UDP/NRP/GDP Alliance will loose the case. For Jammeh will never allow any court decission to say the election wasn't fair there4......?Can any court judge take such a bold step without fear of loosing his/her job? peace janyanfara |

You see, You see? My brothers this was exactly what I was trying portray to most of you readers.Gambians have been in politics since the 1960s.They are no fools. How do you expect them to vote in[as the report states] a self centered politician like Darboe? No wonder the APRC won massively. I Used to be a die-hard UDP supporter but as I think am no fool,I became disellussioned with most of the decissions made above within the UDP executive. When we failed to contest the last parliamentary elections,I was so dissappointed that I decided to though remain an opposition but not to be actively engaged in open campaigns until the formation of NADD when I became again active. When UDP/NRP broke up with NADD,I decided to remain in NADD and am still a NADD supporter. What use would a party have for the people if it cannot represent their interest at the legislative field?. THIS IS CULLED FROM THE POINT NEWSPAPER: Lawyer Darboe’s Election Petition Struck Out Wednesday 25th October 2006
By Modou Sanyang
The election petition filed by the United Democracy Party leader, lawyer Ousainou Darboe, was last Friday struck off by the High Court, presided over by the Chief Justice (CJ), Abdou Karim Savage.
In striking off the case, the CJ stated that the plaintiffs have failed to pursue their case diligently by failing to appear at all the sittings. He opined that one would have thought that once one files a case one would pursue it. But he stated that the plaintiffs have not shown any interest by failing to appear in court.
In her application earlier, lawyer Amie Joof, counsel for the Independent Electoral Commission (IEC), stated that ever since the plaintiffs filed their case, they have not shown any interest to pursue it, by failing to appear in court.
She said she would therefore like to apply for the case to be struck out on behalf of the 2nd defendant, IEC.
Also on her earlier submission lawyer Ida Drammeh, counsel for the 1st defendant, president Yahya Jammeh, stated that the plaintiffs have not shown any interest to pursue their case, adding that the matter involved the office of the presidency. She equally expressed her intention to apply for the case to be struck out since the plaintiffs have shown no interest to pursue the matter by failing to appear in successive sittings.
The Director of Public Prosecution, Emmanuel Fagbenle, on behalf of the Attorney-General, also made a similar application.
Meanwhile the court has ordered lawyer Darboe to pay D5,000 as court cost.

UDP Election Petition Struck Out By Bubacarr K. Sowe
The Chief Justice, Abdoukarim Savage, on Friday struck out the petition filed at the Supreme Court by the United Democratic Party, UDP, on the 22nd September Presidential election.
In his ruling, the Chief Justice said that the plaintiff, Ousainou Darboe, has failed to appear in court and has not been represented. Justice Savage struck out the case, since the plaintiff cannot prosecute it’s case.
In her submission, Ida Drammeh, who stood for the APRC said that the matter should be struck out because the plaintiff has failed to appear before the court.
Appearing for the Independent Electoral Commission (IEC), Amie Joof Conteh agreed with Madam Drammeh’s submission, noting that the plaintiff has not shown interest in pursuing the case. Emmanuel Fagbenle, who appeared for the Attorney General concurred with his learned colleagues. The case was thus struck out.
