THE CHRISTMAS MESSAGE EXPECTED OF THE PRESIDENT

Foroyaa Editorial: Published on Thursday, 26 December 2013

AN EXECUTIVE ORDER AGAINST IMPUNITY! DETENTION AFTER 72 HOURS WITHOUT BAIL OR TRIAL!DISAPPEARANCES WITHOUT TRACE!

The best Christmas or New Year message that Aminata Sowe could receive is to be told where her husband, Momodou Sowe, a protocol personnel, up to the time of his disappearance, is. The young woman who is becoming thinner and thinner every time she walks into the office, appears to be losing her bearing because of misery. Her husband has disappeared without trace. Speculations are rife regarding his whereabouts. The wife responds to all the speculations by paying fares and abandoning her daily chores to engage in a wild goose chase in search of her husband but to no avail, so far. Foroyaa has been helping her in her search but has made no breakthrough up to this very day. The state is responsible for the safety and security of all those who are resident in the Gambia. It has the duty to protect all citizens from arbitrary arrest and detention, torture, inhuman and degrading punishment, disappearances and any unconstitutional and unlawful treatment. No one is of course above the law and there is no complaint due if the due process of law in taken to handle any allegation.
What is necessary is to have independent and impartial tribunals that would preside over cases, on the basis of the best dictates of the law and judicial precedence. We hope that after all the criticisms, the executive will now order all its agents to strictly abide by the dictates of the law. Let’s hope that the spirit of good will towards all human beings will prevail at the level of the criminal justice system of the country.

All Gambians of good faith are hoping for a New Year that would be marked by an exercise of prerogative of mercy to decongest our prisons and humanise our criminal justice system so that no one would ever see reports in the press of disappearance without trace and detention beyond what is constitutionally required without trial.
