"Former NDEA Director General, Benedict Jammeh, former PRO Abdoulie Ceesay, former Director ofIntelligence & Investigation Foday Barry and the former Director of Administration Yusupha Jatta, who were all working for the said agency, on Thursday,2 May, pleaded not guilty to the various counts in the total of 90 charges preferred against them by the state before Justice Mikailu Abdoullahi before the High Court in Banjul.

The various counts, which were initially 92, have now been reduced to 90 counts by the Director of Public Prosecution, S. A. Bakum at the April 30 sitting. During the 2 May proceedings, DPP started reading the charges to the accused until he reached the 45 count when the defence counsel Badou S. Conteh applied for an adjournment which was granted by the Court.

In yesterday’s court sitting the reading of the charges was completed and the four accused persons pleaded not guilty to all the counts. The four defendants are facing the charges listed below jointly or severally. However most of the charges are directed against the first defendant, Mr Benedict Jammeh.

The charges are: economic crime contrary to the section 5(f) of the Economic Crime Act,4 counts;

abuse of office contrary to section 90 of the Criminal Code,44 counts; disobedience of statutory authority contrary to section 115 of the Criminal Code,2 counts;

theft contrary to section 252 of the Crimnal Code,2 counts; giving false information to a public servant contrary to section 114 of the Criminal Cose,24 counts; false publication and broadcasting contrary to section 181A (1),3 counts;

conspiracy to commit a misdemeanour contrary to section 369 of the Criminal Code,1 count;

fabricating evidence contrary to section 98(a) of the Criminal Code 6 counts;

neglect of duty contrary to section 113 of the Criminal Code,7 counts;

stealing by persons in public service contrary to section 257 of the Criminal Code,2 counts.

Further details will be given in the next edition.

The case was adjourned till the 13th of May,2013 for further hearing."
