A government which does not stand for the rule of law does not want to be told that it must do something. On the other hand if a government is truly committed to the rule of law it must abide by the dictates of the Constitution and the laws of the land. The orders given by the constitution should be respected by all persons.

When the constitution says that something must be done it means that it must be done and all persons in government or outside of it must respect its dictate .Every good citizen has a duty to shout at the top of his or her voice to ensure that what must be done is done. To fail or refuse to do what the constitution says is impunity. That is what is called bad governance. Every head of state takes oath to defend the constitution without fear or favour; affection or ill will. We therefore hope that the office of the President would look into the situation of Baba Leigh to find out why he is detained beyond 72 hours without being released or appearing in court, the politicization of the rest aside. This issue is a human rights issue. Today is Friday and Imam Leigh should lead congregational prayers. Up to the time of going to press Imam Baba Leigh was in detention.

Section 19 of the Law of the land orders that no person should be detained for more than seventy two hours without being charged and taken before a court or be released on bail. This is mandatory. What is mandatory must be done. It also states categorically that the person should have access to legal counsel within three hours of his or her arrest. This is also mandatory. It is a matter of must.

Suffice it to say that if one is detained without being taken to court within the 72 hours limit the relatives of the person could go to the high court to apply for a redress of the situation.

Human rights defenders everywhere could also give solidarity to facilitate a person's release or cause him or her to be subjected to a fair hearing. Foroyaa will continue to contribute its quota in defending the liberty and dignity of every natural person on Gambian soil irrespective of background.

The level of lawlessness in the Gambia doesn't have bounds. I believe Foroyaa's report below shows that the genuine everywhere regardless of whether they are back home or outside are expressing concerns about the fate of the Imam. It seriously worries me that the state through its its institutions can deny having him in state custody.
