OK they have got bail, D500,000 ! can they raise that amount? have they got assets in that amount ?

The two former permanent secretaries at the Ministry of Agriculture and three other staff of the same ministry who were remanded recently on theft charges were Tuesday granted bail by Acting Principal Magistrate Taiwo Ade Alagbe of the Banjul Magistrates Court.

Dr Amadou Sowe, ex-permanent secretary No.1; Abdourahman Jobe, ex-permanent secretary No.2; Momodou Mbye Jabang, ex- project manager at the ministry; Mustapha Jatta, ex-accountant clerk; and Bakary LO Sonko, deputy director, Cape Point; where earlier charged for stealing by clerk or servant. They all pleaded not guilty to the charges levelled against them.

When the case was called on Tuesday, Police Prosecutor Superintendent Joof applied for an adjournment on the grounds that investigations on the matter are still ongoing. Lawyer Antouman Gaye, who was leading the defence team, said they were not objecting to the application made by the prosecutor. He told the court that he wished to renew the bail application for his clients, assuring that they would have sufficient sureties.

He further assured that his clients would appear before the court to defend the charges. Lawyer Gaye finally urged the court to exercise its discretion.Prosecutor Joof, in his response urged the court to take its discretion. The presiding magistrate then granted all the accused persons bail in the sum of D500, 000 with two Gambian sureties each and adjourned the case to 22nd of February 2011.

Charges
Dr. Amadou Sowe, ex-permanent secretary No.1; Abdourahman Jobe, ex-permanent secretary No 2; Momodou Mbye Jabang, ex-project manager; Mustapha Jatta, ex-accounts clerk; and Bakary LO Sonko, ex-deputy director, Cape Point, all at the Ministry of Agriculture were charged with stealing by clerk and servant contrary to Section 258 of the Criminal Code Cap 10 Vol 111, Laws of The Gambia, 1990.

The particulars of the offence stated that Dr. Amadou Sowe between the months of March to September 2010 at the Ministry of Agriculture being the permanent secretary fraudulently approved and received on various occasions the total sum of D314,133.62 (Three hundred and fourteen thousand, one hundred and thirty-three dalasi, sixty-two bututs) from the Gambia National Agricultural Investment Programme (GNAIP) fund.

It also revealed that Abdourahman Jobe between the months of March to September 2010 at the said ministry being the deputy permanent secretary fraudulently approved and received on various occasions the total sum of D87,400.00 (Eighty-seven thousand, four hundred dalasi) from GNAIP fund. The particulars also disclosed that Momodou Mbye Jabang between the months of March to September 2010 at the same ministry being the project manager fraudulently received on various occasions the total sum of D350,606.00 (Three hundred and fifty thousand, six hundred and six dalasi) from GNAIP fund.

Mustapha Jatta between the months of March and September 2010 at the same ministry being the accounts clerk fraudulently received on various occasions the total sum of D69,500.00 (Sixty-nine thousand, five hundred dalasi) from GNAIP fund.

Bakary LO Sonko between the months of March to September 2010 at the said ministry being the deputy director Cape Point fraudulently received on various occasions the total sum of D303, 000.00 (Three hundred and three thousand dalasi) from GNAIP fund, and thereby committed an offence.

D500,000.00 bail bond is more than what Mr. Bakary l.o Sonko alledgely stole [D303,000.00]. Where is the logic here?
