Four police officers charged with murder By Bakary Samateh Tuesday, February 08, 2011
A murder charge has been brought before the Banjul Magistrates' Court against four police officers of the Gambia Police Force.
Bakary Demba, Modou Colley, Baboucarr Fatty and Babucarr Jobe were arraigned last Wednesday before acting Principal Magistrate Alagba.
However, their plea could not be taken as the trial magistrate told the court that the alleged offence happened at Jimara district in the Upper River Region, so it would be proper for the accused persons to be tried in that particular jurisdiction, where the alleged offence was committed.
The prosecuting officer, Sgt Manga, told the court that the case was for mention, and for the court to remand the accused persons in custody.
The trial magistrate subsequently ordered the accused persons to be kept in custody pending the commencement of the trial.
According to the particulars of offence, the four accused persons, on 27th January 2011 at Numuyel village in the Jimara district of the Upper River Region and diverse places in The Gambia, murdered one Dembo Sibi, by beating and tying him with a rope causing his death.

Very well done, hopefully they'll get a fair trial and this would send a message to the police that they cannot rough of people...

Dembo’s Suspected Killers in Basse, But Case Not Heard By Baba Sillah Monday, May 16, 2011 The murder case against four personnel of Gambia Police Intervention Unit (PIU) alleged to have tortured 30-year-old Dembo Sibi to death has been transferred to Basse High Court, The Daily News gathered. Babucarr Demba, Modou Colley, Babucarr Fatty and Babucarr Jobe were arraigned for murder at the magistrates’ court in Banjul, but the case was transferred to Basse – the ‘proper jurisdiction’ - in February 2011. It has been reported that the trial will be held a week after the case was transferred. However, The Point Newspaper’s correspondent in Basse says the matter is not heard in Basse yet. Survived by a wife and four children, Dembo Sibi, a native of Numuyel village in the rural-Upper River Region met his death on Friday January 28, following a severe torture unleashed on him by the PIU personnel based in the village. The PIU personnel claimed that Mr Sibi has stolen a motor bike in the village, according to the villagers. But the owner of the said motorbike said, he let Mr Sibi use his motor bike. And yet, the security men have allegedly taken the law into their own hands and even requested a bribe of D3000 from late Dembo’s poor ailing father, family sources alleged.

4 PIU officers charged with murder By Alieu Ceesay in URR Tuesday, May 17, 2011
Four officers of the Police Intervention Unit (PIU) of the Gambia Police Force (GPF) in the Upper River Region (URR) Monday appeared before Justice Emmanuel Nkea of the Basse High Court charged with murder contrary to the Criminal Code, Laws of The Gambia.
According to the particulars of offence, Modou Colley, Bakary Demba, Babucarr Fatty and Babucarr Jobe, all PIU officers on the 27th January 2011 at Numuyel Village in URR unlawfully caused the death of one Demba Sibey of Numuyel, and thereby committed an offence. All the accused persons pleaded not guilty to the charge.
At yesterday’s sitting, Bachilly Konateh, first prosecution witness (PW1) in the case told the court that he knows the accused persons, saying he was at Numuyel on the day of the incident. According to him, two people, Sulayman Sibey and Kalilu Sibey informed him that the PIU apprehended the deceased, of which he went with them to appeal for the release of the boy but to no avail, as they were told that their senior man, who is Babucarr Jobe, the first accused person, went to Gambissara. Konateh said they were ordered by the 3rd accused, Babucarr Fatty, to leave the premises of the guard post, and they complied accordingly.
He further told the court that they later came back in the afternoon to appeal again but still did not succeed. He said he later went home in order to go to his garden. He said while he was at his garden, he received information that Dembo Sibey died.
Madi Trawally, a police officer attached to the Basse Police Station, who was the second prosecution witness, equally identified the four men. He said on the 28th January 2011 while on duty at the station, he was assigned by the Officer Commanding CID Office to obtain a cautionary statement from the guards commander, Bakary Demba, the 2nd accused, which he said he did accordingly. He further told the court that the statement was obtained in the presence of an independent witness by the name Abdoulie Taal. The statement was then tendered in court as an exhibit.
Abdou Sibey, who was PW3, also told the court that when he got the information about his late brother, Demba Sibey’s arrest, he went to appeal for his release and found that his brother’s hands and legs were tied to a wood. He said when he went along with food Demba could not eat but demanded for water. According to him, his brother then asked for help to go to the toilet, as he could not stand on his feet. He said when they arrived at the toilet Demba collapsed and died instantly.
PW4 Kalilu Sibey told the crowded court that when Demba Sibey was arrested, they went there to appeal for his release but were unsuccessful. He said they were asked by PW1 to give him D500 to convince the officers but he said the officers later said the amount was small. Kalilu said they then added D1000 to make it D1500, but the officers demanded for D3000, which they could not afford.
The presiding judge at that juncture adjourned the case to today, 17th May, 2011 for continuation.

Two police officers sentenced to death By Soury Camara in Basse Tuesday, May 31, 2011 The Basse High Court presided over by Justice Emmmanuel Nkea yesterday convicted and sentenced two police officers to death.
Modou Colley and Bakary Demba, both Police Intervention Unit (PIU) officers, were found guilty of beating and torturing one Dembo Sibi, now deceased, which led to his death.
However, two other accused officers, Babucarr Fatty and Babucarr Jobe, who were arraigned together with the convicts, were acquitted and discharged.
In his judgment, Justice Nkea stated that the prosecution had not proved any case against the two police officers, and he consequently acquitted Fatty and Jobe.
Justice Nkea added that the prosecution witness said the two acquitted 'had no direct involvement' in the death of Dembo Sibi.
According to Justice Nkea, it was established by the postmortem report that there was use of excessive force on the body of Dembo Sibi, and it was proved that the deceased died as a result of torture.
Justice Nkea further stated that the evidence adduced by the prosecution's fourth witness proved that the deceased told him prior to his death that he was beaten by the four police officers.
"Taking into account that the duty of a police officer is to protect life, it cannot be accepted that people who are entrusted with the duty to protect life, abused their duty, and go on to cease life," said the judge.
"The right to life must be protected," he said, adding that the constitution of the land must be respected by all and sundry.
He said the death sentence should be carried out on the two convicted police officers, who pleaded for mercy as they are both family breadwinners.
Meanwhile, the two officers acquitted were each granted court bail of D500,000 with one surety each in like sum who must prove an affidavit of means.
The bail conditions further stated that they should be reporting to the PIU commissioner at Kanifing station every Friday.
Justice Nkea also ordered that, if they fulfill the bail condition, they should be reinstated.

This sentence will send a STRONG message to other people in authority that this behaviour will not be tolerated by the Gambian Justice system. Lets hope that there will be NO exceptions. |

It is really saddening to see some still taking the law into their hands. I believe its exposure to the media is a great thing. There are millions of buried cases of torture and maiming out there that never made it to the media. With the few that do surface helps to serve as societal exposures to nib the brutality to the bud. When you just sit down to wonder about the world’s age, just when you think civilization is born, you are daily reminded by some of the most gruesome and inhuman doings.
I hope that I am not judging them until when the verdict of justice is issued....I only hope.

It is very sad that there are still some humans (they are not people) who practice these things even today in EVERY country in the world.
WHEN THE DAY OF JUDGEMENT IS UPON THEM THEN THEY WILL KNOW THINGS MORE FEARSOME THAN THEY THEMSELVES HAVE INFLICTED

Certainly Toubab. Some of the Gambian officers have a record of doing just that. I won't comment any further until I hear the verdict.

I think the whole thing is just a show. How about the guy turtured to death by NDEA officers? What about the killers of Koro Ceesay, Uncle Dayda, 14 Students, 11November?, Daba and Co?, what of the resent killers of Illo Jallow? Are those killers not known by people? Why has no one ever been charged for those crimes?
Oh Gambians how come in God's name do we always jump to praises so fast when these butcher and his blood thirsty thugs calling themselves men in uniform sheds our blood and planned kangaroo courts when we all knew thoise men may be sentenced only for a period or may be taken to former Yundum police Training school to live like small lords in a comming kingdom where the thief would be a future king?
Oh is it because the thief of state knew it is elections approaching and wants to show the people of URR(URD) that he is playing justice here? How about the Station officer commanding that station where the alledged torture took place leading to death? why has he not even been questioned at all? Fellow countrymen and Women, Jammeh would do everything to try fool us all and we all knew it. |
