My favorite Gambian has yet another court hearing....Result.........Adjourned yet again...what is the prosecution playing at The Magistrate should have had the courage to dismiss the case through lack of prosecution,especially as they even failed to turn up and ask for an adjourment....I am a little confused by this,maybe someone can enlighten me :
"When the case was called there was no one to represent the state and Surahata Janneh announces his appearance for the state along side several members of the Bar." I suppose it could be said that Janneh is an officer of the court and was helping out there being no prosecutor in attendence
SBS JANNEH URGES COURT TO DISCHARGE MOSES RICHARDS By Mamadou Dem on 04-02-11 The most senior Counsel of the Gambia Bar association on Thursday applied to the court to discharge his colleague Moses B Johnson Richards who is standing trial on two count charges of criminal offences i.e. False information and sedition. When the case was called there was no one to represent the state and Surahata Janneh announces his appearance for the state along side several members of the Bar. Mr. Janneh told the court that the prosecution is not in court and he believes that there are many prosecutors at the Attorney General’s Chambers. He said they are aware that the prosecution has written a letter addressed as A. Gaye asking for an adjournment in this case and he described the way the prosecution addresses the letter as unsatisfactory.” We are men of dignity and honoured professionals determine to uphold justice at all times and in any circumstance” Said Janneh. He added that the state counsel addressing the letter as A. Gaye is a sign of rudeness because it was supposed to be SBS Semiga Janneh and his team. He said the letter written by the state counsel is asking for an adjournment on the 18 of February 2011 but Janneh indicated to the court that anyone who works for the government especially a lawyer should know that that day is not working day which he describes as carelessness by the prosecution. He reminded the court that this is not the only time that the prosecution is asking for an adjournment in this case. “We (the defence) have never asked for an adjournment in this case” he submitted. He said the case was adjourned to yesterday for but the date was suggested by state counsel. “I urged Your Worship to use section 163 (1) of the Criminal Procedure Code and discharge the accused person” Gaye submitted. The trial Magistrate ruled that he cannot discharge the accused person at this period and he subsequently adjourned the matter to Thursday 17th February 2011 for hearing at 10 AM and a hearing notice to be served on the state.

It's a pity that bro.kayjatta ( I am not an att. etc.!) has not posted recently he could explain things about proceedures,(but maybe there is another lawyer (perhaps even a senior Gambian lawyer )who could join and explain the legal stuff to us normal posters.?
