THE EXECUTIVE HAS DEFINED ITS ROLE THE JUDICIARY SHOULD ENSURE THAT JUSTICE IS SEEN TO BE DONE

During the Swearing in ceremony of the new Chief Justice the President said that he is there to implement the decision of the magistrates and judges. The Constitution has made the judiciary the guardian of rights and justice.
Courts are supposed to be independent and impartial and judicial officers should deliver justice without fear or favour, affection or ill will. The presumption of innocence should be backed by the provision of bail conditions that are just and trials should be characterised by fairness.
A magistrate or judge should be interested in knowing why a person is detained for weeks, months and years without being charged with a crime or brought before a court within the 72 hours limit. Such punishment or inhuman treatment could lead to forced confessions. Judicial officers could make pronouncement on such practices and called on the executive to prevent them from continuing.
The arrest of people who are granted bail by a court should be seen as contempt of court. Bail condition is not supposed to be excessive and should be equivalent to the crime allegedly committed. Hence the just decision of courts should not be subverted by any other authority.
We therefore hope that with this pronouncement by the executive all arms of the state will take stock and set aim to do justice in the making of laws and in their administration and enforcement. Foroyaa will continue to review compliance and inform the public accordingly.
