Deputies suspend debate, urge VP’s appearance

Deputies on Monday suspended the debate at the National Assembly, calling for the appearance of the vice president. The call finally led to the adjournment of the debate.
Speaker Mariam Jack-Denton said the Assembly would adjourn to Wednesday 25 September, 2019, to allow the executive or the vice president to respond to the issues raised.
Hon. Bakary Camara, the lawmaker for Kaing Central, said section 77 (2) of the constitution mandates the National Assembly to use their powers to request for the president to attend to the National Assembly to discuss matters of national interest. However, he added that sub-section 3 of the constitution further says that the president cannot attend the session, but the vice president.
Serrekunda Central lawmaker, Hon. Halifa Sallah, said it is only the vice president who has the mandate to represent the president. “But we also know that all members of cabinet may also come to this National Assembly. They shall also be requested to appear to deal with any matter regarding their departments.” “The reason why I am saying this, is to put an end to this practice of having a minister absent or a vice president absent,” he said.
“We have abandoned the principle of good governance, what is important is that any time any minister goes abroad, the president should appoint an acting person that can appear on behalf of that minister or on behalf of that vice president.”
“Ministers are representing their offices and their departments but not representing the president here,” Serrekunda Central NAM noted.

Members of the National Assembly spent the whole day yesterday debating the address of President Barrow’s state of the nation address on the 19th September, 2019. Up to the time of going to press last night, the lawmakers were still debating.
Looks like the debate may well go on for some time.Dear Reader I suspect that you cannot wait until (as Foroyaa writes below )

October 4, 2019 EDITORIAL.
Some supported the President’s address while many more were critical of it.
Issues of concern included the three years/five years mandate, the need for the state of the nation address to be delivered at the beginning of the year, the white paper on the report by the Janneh Commission, the economy including trade, agriculture and the role of the private sector, fiscal issues, equality of all citizens and a host of other issues of national concern.
Foroyaa will be publishing the views of the National Assembly members and sum up the issues raised.

During their interviews with the press after the president’s state of the nation address critical opinions were expressed by National Assembly members. Some even said that the President should have addressed the three years-five years squabble over his tenure. It is clear that an official pronouncement would have shifted the debate towards a more constructive and conclusive perspective.
There is however the separation of powers. The executive has its say and the National Assembly must also have its say. The National Assembly members adjourned the sitting meant for them to subject the address of the president to critical review with the executive retaining the right to reply. The citizens therefore must be anxiously waiting for this historic face to face debate of the address of the president between members of the executive and the legislature.

The President has spoken. National Assembly sitting is yet to be held. The members refused to speak unless the executive at the highest level is present.
What do they want the executive and the nation to hear? This is what the nation is waiting for. Will there be things said that have never been said before or will the members be repeating the same thing that have been said over and over again?

The action taken by the National Assembly members confirms the separation of powers between the executive and the legislature. 3rd October is awaited with immense curiosity. Will the gallery be full as was the case during the presidential address? Will the media community grace the occasion? The countdown has started. Foroyaa will certainly give the readers all the information they are entitled to have. 3rd October should be a decisive session during which all issues of concern to the public should be fully addressed.

The Adjournment Debate on President Adama Barrow’s State of National Address Saga continues on Wednesday 25 September 2019, at the National Assembly as Law Makers awaits the presence of Vice President Dr. Isatou Touray to represent the President.
The readership could recall that the Debate on the State of the Nation Address was suspended on Monday 23rd September 2019 and the Assembly was adjourned to Wednesday 25th September 2019 for the Debate to commence.
This was as a result of a Motion duly moved and seconded by the august Assembly requesting the President or the Vice President to attend the sitting and participate in the Debate and it was later announced by the Speaker of the National Assembly Hon. Mariama Jack Denton that the Vice President was not within the jurisdiction of the country.
As sittings resumes on Wednesday, the Speaker indicated that her office has immediately conveyed the decision of the Assembly on Monday 23rd September, 2019 to the Office of President of the Republic.
‘’ Hon. Members, I am here to report that the Office of the President has duly communicated to the Office of the Speaker on Tuesday 24th September, 2019, informing this Assembly that the Vice President of the Republic (who is mandated under section 77(3) of the Constitution to answer to matters affecting the President in this Assembly) is currently away on an official mission’’.
According to the Speaker, the Office of the President has communicated the unavailability of the Vice President until 3rd October, 2019. Hon Jack Denton affirmed that cognizant of the provisions of the Constitution on this matter, coupled with the express intention of the motion of the Assembly which was duly passed and that in the absence of the President, it is only the Vice President who is mandated by law to speak for the President in the National Assembly.
‘’ I will therefore invoke clause 9(1) of the Standing Orders to adjourn this Assembly until tomorrow 26th September, 2019 to consider other businesses of the Assembly. Equally, I will suspend the debate on the State of the Nation Address until Thursday 3rd October, 2019 to allow the presence of the Vice President to attend the sitting and partake in the debate’’.
‘’ For the purposes of clarity, the Assembly will be adjourned until tomorrow Thursday 26th September, 2019 for consideration of other businesses, while the debate on The State of the Nation Address will now commence on Thursday 3rd October, 2019.

National Assembly on Monday 23 September 2019,has suspended the adjournment debate on President Adama Barrow’s State of National Address which was recently held at the National Assembly Chambers in Banjul due to the nonappearance of neither the President nor Vice President to respond to the concerns of the deputies.
This suspension came following Hon. Samba Jallow’s (Minority Leader) observations on the absence of the executives of the government. Hon.Majanko Samusa suggested that Assembly should stand down demanding the presence of the executives.
However Hon. Sedia Jatta member of Wuli West, who moved the motion for the Assembly to stand down, cited that it is a Constitutional mandate for the President to appear before them and respond to issues regarding his state of the national address and in his absences the Vice President should step in.
Section 77 subsection 2 of the constitution states ‘’that the National Assembly may request the President to attend a sitting of the National Assembly for the discussion of a matter of National importance and sub-section 3 states that Vice President shall answer in the National Assembly for matters affecting the President, and the President shall be entitled to send a message to the National Assembly to be read on his/her behalf by the vice president while sub-section 4 states that the Vice President or a minister shall when requested by the National Assembly report to the National Assembly on any matter concerning a department or other business of government committed to his/her charge and shall be entitled to attend and speak in the National Assembly whenever any Bill or matter concerning such department or business is been debated’’.
After an hour of the stand down of the National Assembly proceedings, waiting for the arrival of the President / Vice President , the Speaker of the Assembly Hon. Mariama Jack Denton indicated that the Vice President is not within the jurisdiction of the country therefore the Minister of Youths and Sport Hon. Hadrammeh Sidibeh and the Minister of Fisheries and National Assembly Matters Hon. James Gomez had to appear on behalf of the President to address the issue at hand.
Unfortunately for the two ministers their presence doesn’t matter as majority of the NAMs were still insisting on the presence of the President /Vice President as stipulated in the constitution.
For his part Hon. Halifa Sallah NAM for Serekunda, asserted that they (NAMs) must proceed in a way that will defend the integrity of these National Assembly at all times. He affirmed that the portion quoted is very clear in terms of representing the President in the National Assembly.
‘’It is only the Vice President who is authorized and mandated to represent the President. What we also know is that all members of cabinet may also come to these National Assembly/ shall also be requested to appear to deal with any matter dealing with their department of state, that’s what the constitution is saying.
Hon. Sallah emphasis the Need to put an end to the practice of having a minister or a Vice President absent from their constitutional mandate. He reiterated that the principles of good governance have by abandon.
At this stage Hon Sulayman Saho moved a motion for the Assembly to adjourn until the presences of the Vice President or the President’s representative appear before the business of debate on President Barrow’s address proceed, his motion was seconded by Hon Fakebba Colley of Kiang West.
Members did not unanimously agree so the motion was put to vote and the yes has 28 votes and the Nos has 11.
So Assembly adjourns till Wednesday 25th September 2019 @ 10am prompt.
