JUDGE NOT AVAILABLE WHILE SOVEREIGN GAMBIANS ARE DENIED BAIL SPEEDY TRIAL IS A PILLAR OF JUSTICE

Justice delayed is justice denied. We have argued over and over again that presumption of innocence makes it mandatory for bail not to be excessive and not to be unreasonably denied. Unfortunately, some judges have been denying bail to many accused persons and have been imposing bail conditions which could not be met.
Hence what should be done is to continue the trials on a weekly basis.
The longer it takes to try people who are remanded in custody the greater the degree of injustice perpetrated against them. In short, to remand a person in custody without speedy trail is to subject him or her to the principle of presumption of guilt until proven innocent.
This is the justice system of monarchs and tyrants and not that of Republics and Democrats.
The Chief Justice should review the type of bail conditions imposed on accused persons and the speed of the trials once they are denied bail.
The law and standard of best practice are not silent on this.

LACK OF JUDGE DELAYS EBRIMA JAWARA AND CO TRIAL

 The trial of Ebrima Jawara and four other staff of the Rural Finance Ebrima Jawara, CPCU Coordinator Project under the Ministry of Agriculture failed to proceed on Tuesday,
13th October, 2015 due to lack of a judge to preside over their case.
The accused persons, who were granted bail, with the exception of Ebrima Jawara, could not fulfill the conditions which require them to pay the sum in cash to the Principal Registrar of the High Court and are therefore detained at Mile Two central prison.
The said sums are D6 million for Sulayman Manneh, D7 million for Lamin Fatajo and Lamin Mass and D10 million for Dr.Alasan Bah.
When the accused persons appeared on Tuesday with their counsels, they were told that their trial could not proceed due to the lack of a judge after having spent an hour waiting.
When this reporter contacted the Judicial Secretary to shed light on the issue, Landing M. Sanneh explained that the judges were on vacation and had resumed recently and that Justice Balarabe, the vacation judge, who was presiding over the case was on casual leave.
He, however, said that things will be normal by next week. |
