Not turning up or not presenting documents on time appears to becoming standard practice in SOME cases,a "Clarification FIX " must be developed in order to stop future occourences.

The Public Enterprise Committee (PEC) has on Tuesday adjourned two sessions due to the absence of external auditors for one enterprise and the board chair for another enterprise.
The select committee was supposed to listen to the presentation of the financial statements and activity reports for the periods of the Gambia Civil Aviation Authority (GCAA) in the morning, but the engagement could not hold because the aforesaid enterprise’s external auditors were not present.

The officials of the enterprise said their external auditors were not in the country and they are expected to be back on Friday.

The chair of the committee, Hon. Halifa Sallah said the whole exercise is for them to carry out their mandate, which is to ensure that public enterprises are guided with three principles, such as decency, transparency, and probity.

“Clearly, we cannot complete a review exercise without the management letter and all these issues being looked into. The exercise would be difficult,” he said.

Nonetheless, the engagement between the GCAA and the Select Committee is being deferred to 17th February 2020 for presentation, and on 19th February for possible consideration of the reports for the periods under review.

In the afternoon session, the Gambia Competition and Consumer Protection Commission (GCCPC) too could not engage with the committee because the chair of the board was absent.

Janet Sallah-Njie, the former chair of the GCCPC (though she presented herself as the outing chair), said she was there because the periods under review (2015, 2016, 2017 and 2018) fall within her chairmanship. The commission currently has a chair.

She said the board had a meeting and they agreed among themselves that hence she had the institutional knowledge for the periods under review; she could present the reports on behalf of the commission.

“I spoke to him (current chair) this morning and he explained to me that he has health commitment in the provinces,” Sallah-Njie said.

However, the chair of the select committee, Halifa Sallah, said the former chair is not mandated to present the reports on behalf of the commission. He added that the standard is for the committee to communicate with the board through the chair.

“But the substantive holder is the one responsible to appear before us and to make that known to us; to indicate that the board has actually mandated you (former chair) to be the presenter before this committee,” Sallah said.

Meanwhile, the engagement amid the committee and the commission was then adjourned until further notice.

The engagement the Public Enterprise Committee (PEC) of the national assembly was supposed to have with the National Agency Against Trafficking in Person (NAATIP) was adjourned due to the absence of the executive director of the agency and the incomplete reports for the year under review.

NAATIP was supposed to present its activity report and financial statement for the years ended 31 December 2015, 2016, 2017, and 2018 on Wednesday before the PEC.

Abdoulie Sissoho, the chairperson of the board of directors of NAATIP, said the executive director is bereaved and is not in the right state of mind to attend the session. Thus, Mr. Sissoho appealed to the select committee to reschedule the session to another date.

Asked whether NAATIP has submitted its activity report and financial statement for the year 2015, 2016, and 2017, Mr. Sissoho responded in the affirmative. However, he said the 2018 activity report and financial statement are yet to be finalized.

The chairperson of the select committee, Hon. Halifa Sallah, said the agency through the interaction it had with the select committee is prepared to submit its activity report and financial statement for the year 2015, 2016, 2017 and 2018 for presentation.

“We would be requesting for that to be done and then we will have a consolidated presentation of the reports that are yet to be presented so that we put an end to the backlog once and for all and then start afresh with the 2019 report whenever it is presented because it is not due,” he said.

The committee then proposed that the session be adjourned until a later date.

It would seem that there is still some extensive work to be done to "clarify" historic non appearences.Still a timeline is in place.

The Public Enterprise Committee of the National Assembly has on Monday adjourned its engagement with the Gambia Groundnut Corporation due to the absence of external auditors.

Muhammed Njie, Managing Director of GGC said they had two engagements as the same day at the national assembly and as a result they could not attend both.

Hon. Halifa Sallah, the chair of PEC, said there was an engagement they had with the management about their commitment to back an end to the backlog before 31 December, 2019 for the 2018 reports so that by 31 March, 2020, they would be looking at 2019 activity report and financial statement.

“Since that has been a difficulty, we have decided that if you submit the two together, this will put an end to the backlog and work on the 2019 and make sure that before 31 August 2020 all institutions submit their 2019 reports. That would put an end to the backlog,” Hon. Sallah said.

The national assembly member for Serrekunda, Hon. Sallah said as long as they are dealing with history, they would not be able to catch up with the challenges they are grappling with and the reason for having audited accounts is to have fair representation of the state of affairs of each institution.

Mr. Njie said they are delighted that they are accorded the opportunity to work on the backlog of the financial statements. He reassured the committee their commitment to ensuring that the backlog saga is addressed. He added that they are going to engage the external auditors to ensure the financial statements are audited.

Njie said for the 2018 to be finalized, it could be in the next two months. He said at least by May, they should be ready to present 2017 and 2018 activity reports and financial statements.

Chair of the committee Hon. Sallah said they have to engage the ministry of finance to ensure the bottleneck is addressed.

Njie added that they would engage the clerk of the committee and board of the corporation to come up with a timeline and report back to the committee.

What a very sensible decision by the PEC to solve a lack of respect for a committee of the National Assembly yes folks ACTION by politicians, quite a rare development,it would be great if other politicians worldwide followed their lead.

The Public Enterprise Committee (PEC) of the national assembly has decided to end dealing with history by putting an end to the backlogs public institutions are grappling with.

Quite often, the committee had to adjourn or defer sessions because the enterprises that were supposed to present before the committee would not have the complete sets of reports, which include activity report, financial statement and management letter.

PEC has since the advent of the new dispensation clamoured for an end to the backlog to no avail. Some are complying while others fall short. Some of the enterprises are yet to present previous reports as far back as 2015.

Moving on, the chairperson of the committee Hon. Halifa Sallah said they have set out plans to put the matter behind them.

“We want to put an end to the backlog… the committee have decided that we will not deal with history anymore,” he said.

One of the measures the committee is implementing is to ensure the enterprises meet all the reports for the periods under review before they would be allowed to present before the committee.

One institution which is being asked to adhere to this is the Gambia Competition and Consumer Protection Commission (GCCPC). GCCPC would appear before the committee again for consideration when they prepare all the activity reports and financial statements for the year 2015, 2016, 2017, and 2018. The institution is yet to prepare its financial statement for 2018.

Sallah told the commission that there are problems somewhere and they would engage them and the external auditors to discuss and ascertain the problems so that they can be resolved.

“Just get ready to explain everything that is serving as impediment to the proper functioning of your institution and then the auditors will also explain and we find a solution that this time, the backlog will definitely be a thing of the past,” the Serrekunda deputy said.

He added: “Because the commitment of the committee is that we will not hear any report until the 2018 financial statement is prepared.”

The story of PEC is similar to other select committees of the national assembly. Last week, the select committee on Regional Government and Lands, Ombudsman and IEC faced a similar situation.

The committee is responsible for area councils in the country and it has rejected reports of the Janjangbureh Area Council and Basse Area Council due to incomplete reports.

Both area councils failed to present their financial statements for the year 2015, 2016, and 2017- with Basse having 2018 activity report ready but without its financial statement.
The committee has given both area councils three months to put their house in order or else it would be contempt of the national assembly.
