I am always concerned when an area council wants to tinker with "Local Laws" I think that the LAW of the Gambia as a nation would be weekened if local councils were encouraged into making Local Laws,this popularisation of new by laws may cause more problems than thay solve.
Personally I would love readers of Mantaba in Cyberspace to post a reply outlining their feelings and observations,will that happen.......lets see.

The authorities at the Kanifing Municipal Council said they want to initiate the process of popularizing By-Laws they enacted in June 9th 2020.
They said they want to communicate this Bye –Laws to their communities through local languages.
“The by-laws are enforceable from June 9th but we have a strategy of communicating the existence of the by-laws through translating it in all the local languages to make sure it is understood,” Mayor Bensouda said.
A by-Law is a rule or law established by an organization to regulate itself, so in this case the Kanifing Municipal Council by-laws are to control its municipality.
The penalty for the violation of these By-Laws is liable to a fine of not more than one thousand dalasis or an imprisonment for a term of not more than three months.
The Mayor said one of the council’s biggest responsibilities as a local government authority is to establish order and the rule of law within its communities since the constitution does not cover all aspects.
He said since he came to office in 2018, his council has had many complaints from their communities about lack of order, civil disobedience and conflicts between neighbours. He went on saying this is all due to lack of local governance.
Mayor Bensouda alluded that the Kanifing Municipal Council under his leadership has come up with its first comprehensive by laws and that it is the first of its kind.
“We are proud to say we have now introduced the first of its kind comprehensive by-laws for our municipality,” the Mayor said.
He said disturbance such as loud noise, having ceremonies and other public events late at night without the consideration of their neighbours are reasons that led KMC to come up with comprehensive by- laws to guide their communities and to ensure there are penalties if one disrupts their community.
He went on to inform that they need help from all the security task force heads since it is their responsibility to make sure it is enforced, adding that KM is their municipality; if it is organized the Gambia will be organized.
“The security task force chiefs we will rely heavily on you to make sure that these by-laws are fully enforced,” he added.
“The first important thing here is community policing to tell one another when they are wrong and if they refuse to listen and report them to the right authorities, I think this is what good citizenship is about and this is what we will expect residents of KM to do.” |

Animal owners in KM will now pay a fine of D1000 if their animals are found straying in the streets. “A person shall not – cause any animal to graze in streets, highways, squares, avenues, or other public places without a written permit from the Council, or allow his or her animal to be roaming on the streets,” the KMC new by-laws stated.
It further states that any animal found roaming in the streets shall be impounded by the council which shall, within two weeks, issue a public notice about the impounded animal and if there is no claiming, the animal shall be auctioned and the proceeds paid to the council.
Henceforth, an owner of an impounded animal shall pay a fine not more than D1000 before the animal is released to him or her.
Nuisance
Another law, called the Nuisance Law, provides that in the event a family in a locality is bereaved, persons living within the same locality shall exercise the traditional practice of neighborliness and refrain from any activity that might cause a nuisance.
“Also, a person shall not between 2:00am and 4am play or use a loud musical system or a public address system, or use any industrial machine in residential area, which may cause nuisance,” the law stated.
It further states that a person who intends to play or use a loud musical system or a public address system, or use any industrial machine in a residential area after 2:00am shall obtain a written permit from the Council or the competent authority except for religious activities.
“A person shall not conduct any activity or business on highways which causes obstruction or nuisance to the road users without a written permit from the competent authority,” according to the nuisance law.
Maintenance of property law
According to this law, a compound owner in the KMC shall ensure that the periphery of his or her compound is kept clean by the inhabitants at all times; and maintain the pavement frontage of his or her property according to the specifications of the council and the Department of Physical Planning.
“A person shall not dump waste on undeveloped or unfenced property, or use undeveloped property for unauthorised activities,” it said, warning that
A person shall not remove any sand, stone, gravel rock or artificial protection from any beach, streets or a public place without a written permit from the competent authority.
In the same vein, a person shall not connect a private sewage pipe to a public drain without a written permit from the competent authority no dispose of waste products and hazardous products on the streets or unauthorised areas including drains or waterways and burning of any form of substance that is hazardous to humans or pose health repercussions. |
